Breaking Belief against Racial Discrimination
Racial Discrimination, still an issue
All through the United States History, racial discrimination, or an unfair and abusive behavior towards different race, has been a problem. More likely, this is a major issue when it comes to business industry.
Although the different states have laws and legal prohibitions against racial discrimination, still, it is inevitable in the workplace, and such laws were ineffectual.
Below is a report from the United States Department of Labor in November 2007 about the unemployment rate:
- Black Americans- 8.4%
- Non-Hispanic Whites- 4.2%
- Hispanics- 5.7%
The rate shows that the black Americans have the highest percentage of unemployment, twice as that of non-Hispanic Whites.
Furthermore, according to the statistics issued by the U.S. Equal Employment Opportunity Commission, it shows that out of the 75, 768 charges they have received in 2006, there are 27, 328 (35.9%) related to racial discrimination.
This is actually a proof that there is racial discrimination in the workplace.
Discrimination as against to applicants
Racial Discrimination happens not only when an individual is working as an employee already. It may also take place even when a person is just applying for job.
Discrimination of applicants can be determined when:
- The applications ask improper, biased and discriminatory questions.
During the application process, the employer asks questions to the applicant to know his background, status, etc. However, if the questions lead to an intention of excluding an applicant from employment, and will not be used for legitimate purposes, it would be an evidence of discrimination. - There is a huge difference in the qualifications which is favorable to only some applicants
- The selection process is considered unfair
An employer may sometimes do not provide equal opportunity for applicants. Instead of using their background and experience, there are employers who base their decision on race.
As the law states
It is actually stated in the law that “it is unlawful for an employer to fail or refuse to hire… because of such individual’s race, color, religion, sex or national origin.”
The Court rules that companies can be held liable once the pre-employment selection process is concluded to be discriminatory. Since, it is known that it is a company’s duty not to discriminate a person based on race, even before he is hired.
In addition, it is mandated that equal employment opportunity should not be denied if a person is associated with or member of different race.
Defense against discrimination
Since discrimination is against the law, you already have grounds to complain when you experienced discrimination even when you are just applying for job.
If you are discriminated based on race, you can do the following:
- Address your concern to the employer who did such illicit act
- If it is ineffective, you can report it to the company itself.
- Keep a record of what you experienced during your application
- Jot down names, telephone numbers or addresses, names of witnesses if possible
- File a charge of discrimination in the U.S. Equal Employment Opportunity Commission.
- It is better that you seek assistance from attorneys who are expert in handling racial discrimination cases.
