Family and Medical Leave Act
The Family and Medical Leave Act is a part of the U.S. Labor laws which is signed by then Pres. Bill Clinton and enacted on February 5, 1993 to let the workers, who absented in their jobs for quite a while due to their sickness or to take provide care for a sick family member, to take their unpaid leave. This would mean that an employee can take a leave for a period of twelve weeks in a year provided that he had a valid reason. He is also assured of still having the same job position, or other work which has the same salary, benefits and duties in case his position is taken, upon reporting back to work.
Moreover, he is still eligible for the same benefits even while on leave. The Family and Medical Leave Act also protect the employees from any retribution by their employers for utilizing their rights under this act. Primarily, this provision in the labor laws aims to maintain the balance in a person's obligations in work and family and to render some other safeguards on the employees' rights. This leave can also be irregular; meaning the employee may exercise his work in a part-time arrangement.
Subsequently, although the Medical and Family Leave Act promises a number of benefits for the employees, others are still unfortunate in being unable to meet its conditions. Workers tend to be afraid of losing their jobs. They are also quite unaware about the statutes of this law which is the basis of their right to take their leave. These very reasons constrain them to further pursue their rights not knowing that they have the option to seek the legal assistance of a competent employment lawyer to help them in their legal problems.
