PREMISES LIABILITY: Lawsuit filed Against Bakersfield Zoo after Raccoon Attack
December 28, 2010
Bakersfield – A man filed a personal injury lawsuit against the Bakersfield zoo and museum after being attacked and injured by an escaped raccoon during their visit.
The lawsuit was filed by Ian Smith, 31, from Bakersfield. According to the lawsuit, the incident occurred last January 31st, during one of the zoo’s live exhibit.
Smith, who is a trained kick boxer, claimed that he fought off the raccoon for several minutes before it was captured and later euthanized.
He sustained bites in his foot and leg, and a tear on his finger; he also claims that his 9-year-old daughter suffered personal pain and suffering after seeing his father being attacked.
Smith is seeking $25,000 from the California Living Museum to cover for lost wages and medical expenses.
The Kern County Superintendent of Schools, who manages the zoo, says they will reach out to Smith to see if they can arrive at a solution that is mutually acceptable to both parties.
