DISCRIMINATION LAW: Muslim Woman Fired Over Wearing of Headscarf

San Mateo - A Muslim woman has filed a discrimination complaint against Hollister clothing store, a subsidiary company of Abercrombie & Fitch, claiming that she was fired after refusing to remove her headscarf.
Hani Khan, 19, said she was dismissed from her job as a part-time stockroom worker a week after a district manager told her in a meeting that she was not supposed to wear a scarf while at work.
Khan also said that a human resource staff said that wearing a scarf was in violation of the store’s “look policy”.
The political science student said she was surprised at her dismissal since she had wore a headscarf during her interview, adding that her direct supervisors even allowed her to wear this as long the color will be the company’s theme color of gray, white, and navy.
Khan said she the Council on American-Islamic Relations, a Muslim advocacy group, has helped her file a discrimination complaint before the US Equal Employment Opportunity Commission (EEOC).
When asked about the charges, Abercrombie & Fitch declined to give comments.
In September 2009, the clothing giant has also been charged with discrimination suit filed by a 17-year-old Muslim who claimed that she was not hired for wearing a headscarf.
