Sexual Harassment

Under the Title VII of the Civil Rights Act of 1964, sexual harassment is considered a form of sex discrimination. As such, any unwelcome sexual advances, request for sexual favors, or any behavior of lewd, obscene or intimidating behavior which unreasonably interferes with an individual's performance at work or affect his/her employment can be considered sexual harassment as well. Unfortunately, while a massive campaign against the perils sexual harassment is being done, many businesses are yet to address the hidden problem in its workforce.

Sexual harassment can take many different forms, but generally anyone can be the harasser, regardless of sex or position in the workplace. And sexual harassment doesn't have to be in the form of obtaining sexual favors; sexist remarks or explicit and demeaning comments alone can constitute sexual harassment. While adverse effects on the victim usually arise from sexual harassment, the presence of these is not a prerequisite to consider the occurrence as unlawful. Awareness and proper training at the workforce is the best way to prevent sexual harassment. Most states nowadays require workshops and trainings for both the employees and the managers/supervisors to make them aware of their employee rights and how to deal with issues regarding sexual harassment. Anti-sexual harassment policies must be adopted as well, and employers must make it clear that there's zero tolerance whatsoever regarding sexual harassment. They must also establish an effective complaints and grievance process so that immediate action will be taken when an employee files a complaint.
