Understanding Tort Law

Tort laws generally govern personal injury cases as well as other civil wrongdoings committed by a person. It does not, however, include breach of contract. Torts involve cases wherein a person suffers injuries and damages because of the other’s negligence and errors.

Torts often include:

  • Invasion of privacy
  • Negligent or intentional inflicting of emotional distress
  • Intrusion of another’s business interests
  • Defamation / libel / slander
  • Physical injury or assault
  • Trespassing of other person’s property

The word “tort” translates to “civil wrong” and so many cases can fall under it. There are instances wherein a professional’s negligence would inflict harm on others and there are those wherein intentional attacks would cause damages to the plaintiff.

Personal Injury Cases

This includes the negligence of other people which results to property damage and physical or emotional distress. Cases of personal injury can also result to wrongful death wherein the beneficiaries of the deceased can claim compensatory, and possibly punitive, damages in their behalf.

Here are some of the most common examples of personal injury cases:

  • Vehicular accidents – These are the leading causes of deaths in the nation and so someone is being held accountable for it every minute. Speeding, DUI, and inattention to driving are the common causes of accidents on the road and so everyone must be cautious amd responsible drivers.
  • Medical malpractice – Doctors and other medical professionals are responsible for their patients’ health. So, they must exercise quality care and concern towards their patient in order to alleviate their pain and not cause further suffering.
  • Product liability – Manufacturers of equipments and other goods must make sure that their products are safe for human use and consumption before releasing it to the market. They must be able to conduct quality assurance tests to prove its sturdiness and good quality.
  • Premise liability – Establishment owners are responsible in maintaining their property free from any hazardous condition that can result to an accident. Also, they must provide warnings to guests and passersby if their property is under construction or renovation so as to minimize liability in accidents.

Injuries in these cases range from a mild concussion to serious head and spinal injury which may require treatment for as long as the victim will leave. So, it is only justified if they seek compensation for the damages on their part.

The defendant, once proven guilty, will have to financially compensate the victim or his beneficiaries. Compensatory damages for these accidents often cost a lot and so both parties must invest in hiring good personal injury lawyers in order to prove their claims and be properly compensated.
