EMPLOYMENT DISCRIMINATION: Veggie Packing Company Agrees to Pay $80,000 Settlement for Disability Discrimination Suit
April 1, 2011
Oregon - Umatilla based South Basin Packing agreed in paying $80,000 and provide other aids in settlement of a disability discrimination case filed by the EEOC.
The potato and onion packer terminated a 57-year-old male employee after informing them that he was diagnosed with a chronic illness, said EEOC San Francisco District office chief Michael Baldonado.
Baldonado affirmed that the forklift operator still has full capability to perform his job based on their investigation. “The ADA seeks to ensure that competent workers do not fall victim to myths and stereotypes about disabilities. Fortunately, the measures that South Basin has agreed to implement will protect their employees with disabilities from facing this kind of treatment again”, he further said.
Under the settlement decree, South Basin will pay $80k to the terminated employee. The company will also formulate new policies and conduct employee and management trainings on disability discrimination prevention.
South Basin refused to give further statements regarding the settlement.
